Why Your Governing Documents Are the Starting Point
Most HOA and condominium governing documents, the CC&Rs (Covenants, Conditions and Restrictions), bylaws, and operating rules, were written long before electric vehicles were common. Many are silent on charging, and some flatly prohibit residents from altering common areas or running new wiring. Before a board approves a single charger, it needs to know exactly what its own documents say.
These documents form a hierarchy. CC&Rs are recorded against the property and carry the most legal weight. Bylaws govern how the association operates. Operating rules (sometimes called rules and regulations) are the most flexible, adopted by the board to fill in day-to-day details. EV charging usually touches all three, and the level of the document determines how hard it is to change.
Boards that skip this step often discover mid-project that their CC&Rs require a full membership vote to allow any common-area modification, a process that can add months to the timeline. Reading the documents first, ideally with the association's attorney, prevents that surprise.
Right-to-Charge Laws Override Restrictive CC&Rs
A growing number of states have passed "right to charge" laws that limit how much an HOA can restrict EV charging, and these laws override conflicting language in your CC&Rs. California's Davis-Stirling Act (Civil Code Section 4745) is the most detailed: it makes void and unenforceable any governing-document provision that prohibits or unreasonably restricts the installation of an EV charging station in an owner's designated parking space or exclusive-use common area.
Other states with similar statutes include Florida (Section 718.113(8) for condominiums), Colorado, Oregon, Hawaii, New York, Maryland, and New Jersey, among more than a dozen in total. The details vary, but the common thread is that a blanket "no" in your CC&Rs is very likely unenforceable.
These laws do not eliminate the board's role. They explicitly allow associations to impose reasonable conditions such as architectural review, insurance, and cost responsibility. Under Civil Code 4745, the association must approve or deny a complete application within 60 days, and an owner installing in a common area can be required to carry a $1 million liability insurance policy. The job of your governing documents is to spell out those reasonable conditions clearly.
Rule Amendment or CC&R Amendment? Know the Difference
One of the most important decisions a board makes is whether it can handle EV charging through a board-adopted operating rule or whether it needs a full CC&R amendment. The two paths have very different requirements, and choosing the wrong one wastes time.
A board operating rule can usually be adopted by a majority vote of the board after giving members notice and a chance to comment. In California, Civil Code Section 4360 requires at least a 28-day notice-and-comment period before the board adopts or changes an operating rule. Rules are ideal for procedures: how residents apply, what insurance they carry, and how electricity gets billed.
A CC&R amendment is far more demanding. Because CC&Rs are recorded covenants, changing them typically requires a vote of the membership, commonly a two-thirds (67 percent) supermajority, though the exact threshold is set in your own documents. If your CC&Rs flatly ban common-area alterations or new wiring, you may need to amend them, not just pass a rule.

What a Good EV Charging Policy Should Cover
Whether you adopt a rule or amend the CC&Rs, the substance is similar. A complete EV charging policy answers the practical questions before they become disputes. At a minimum it should address the application and approval process, equipment ownership, cost responsibility, insurance, and ongoing maintenance.
Boards should be specific. State who pays for the charger, the electrician, and the electricity, which is almost always the resident for a dedicated space. Require a licensed, insured contractor and a pulled permit. Spell out that the resident, not the association, is responsible for repairs and for any damage the installation causes to common property.

The Adoption Process, Step by Step
Once the board decides on the right vehicle, the adoption process is straightforward but should not be rushed. Cutting corners on notice requirements is one of the most common ways a well-intentioned policy gets challenged later.
Document everything along the way. Minutes should reflect the notice given, the comments received, and the final vote. A clean paper trail is the association's best protection if a resident later claims the policy was adopted improperly.

Mistakes That Create Legal Risk
The fastest way to invite a lawsuit is to adopt a policy that conflicts with your state's right-to-charge law. A blanket prohibition, an unreasonable delay, or a requirement that makes installation prohibitively expensive can all be challenged as unenforceable, and in some states the association can be ordered to pay the owner's attorney fees.
Two specific traps deserve attention. First, do not ignore exclusive-use common areas, the assigned parking space, balcony, or patio an owner has the right to use but does not own outright. Right-to-charge laws often extend to these spaces, so your policy must address them. Second, do not set insurance or review requirements higher than the law allows; California, for example, caps the required liability coverage at $1 million. Getting the policy right the first time keeps your community welcoming to EV drivers while protecting the association from avoidable claims.
